Vice President Comments on Plan to Amend Military Court Law

TEMPO.CO, Jakarta – Vice President Ma’ruf Amin believed that amendment or revision of the law is a regular thing, including the amendment to Military Court Law No. 31 of 1997. The issue related to the amendment was raised after the detainment of several active military members related to the National Search and Rescue Agency (Basarnas) graft case by the Corruption Eradication Commission. 

“I believe a revision to a law is a regular thing, including toward the Military Court law. Some provisions will need to be adapted to current reality,” said Ma’ruf Amin in Samarinda, East Kalimantan, on Friday, August 4, 2023.

Ma’ruf said the decision of Coordinating Minister for Politics, Law, and Security Mahfud MD to announce that the government will consider the possibility to revise the law, is appropriate.

According to the Vice President, Law provisions have to accommodate the public aspirations and the current reality. “I think the [Military Court Law revision]should proceed according to the public aspirations,” he said.

Previously, the Head of the National Rescue Agency (Basarnas) Air Marshal Henri Alfiandi named a suspect in the alleged graft case in Basarnas by the Military Police Corps on Monday, July 31, 2023. However, Corruption Eradication Commission (KPK) named the military member as a suspect first on Wednesday, July 26, 2023.

Several parties have advocated for the amendment of Military Court Law since they fear the law would cause impunity to active military members tried in the military court.
